Today I want to talk about one big thing on every social media, but especially on Instagram: Giving credit.
I want to focus on the nail art community here, but let's start with some general points that count for every photo, post and video.
Heute ist hier leider einmal nicht nur Sonnenschein und Regenbogen.
Hute möchte ich etwas über ein Thema sprechen, dass in der Social Media Welt, besonders aber auf Instagram, allgegenwärtig ist.
Ich beziehe mich dabei hauptsächlich auf die Nail Art Community, ein paar allgemeine Punkte habe ich zu Anfang aber auch mitzuteilen.
I'm sure you all know that. You scroll down your Instagram feed and find a wonderful and pretty picture. It's just something you would've photographed yourself. It would look beautiful on your page and your followers would love it.
So what about reposting it? I mean, that's no big deal. It's just Instagram, right?
Wrong. You are not allowed to simply repost a picture. You are not allowed to state it as your own. It's against the terms and conditions. And it's theft.
When you repost a picture and not identify that it's not yours, it could have severe consequences.
But don't worry, you can repost a picture when you give proper credit to the user you got it from.
It's not enough to just tag them on the picture, you have to include the credit in the caption.
Example caption: "I just stumbled across this wonderful photo and immediately fell in love! Credit to @usernameexamplecat".
And voilà! Everything's fine. It's not that hard, right?
Side note: It's even better to ask the owner if it's okay if you repost the picture, even if you give credit, some people just don't like seeing their pictures on other people accounts and that has to be accepted.
Heute geht es mal um ein ernsteres Thema, um etwas, dass mich immer wieder beschäftigt.
Ich bin sicher, ihr kennt das auch. Man scrollt durch seine Neuigkeiten und stolpert über ein wunderschönes Bild. Eines, das man genau so auch fotografiert hätte, das sich wunderbar auf seiner Seite machen würde und seinen Abonnenten würde es sich auch sehr gefallen.
Also los, reposten wir es einfach.
Da ist ja nichts bei. Keine große Sache, es ist ja nur Instagram, richtig?
Falsch. Man darf nicht einfach das Bild von jemand anderem nutzen. Man darf es nicht einfach auf seinem Account teilen und es somit als sein eigenes ausweisen. Man darf das Urheberrecht nicht verletzen. Es ist gegen Instagrams AGB's und es ist Diebstahl.
Beachtet man dies nicht, kann das ernsthafte Konsequenzen nach sich ziehen. Dass Instagram den Account löscht ist da noch mit das harmloseste.
Aber jetzt keine Panik!
Natürlich kann man die Bilder anderer reposten, wenn man einige Dinge beachtet.
Es ist unbedingt notwendig, dass auf den ersten Blick erkennbar ist, wessen Bild das geteilte wirklich ist. Dabei reicht es nicht (!), die Person nur auf dem Foto selbst zu markieren. Der Name muss in der Bildunterschrift erscheinen.
Diese könnte dann zum Beispiel so lauten: "Was für ein tolles Bild der lieben @beispielnamekatzekatze!".
Und voila! Alles paletti. Kein Urheberrecht verletzt, alle sind zufrieden und trotzdem konntet ihr das Foto teilen. Ist doch eigentlich super easy.
Einen kleinen Tipp hab ich aber doch noch. Nicht alle User sehen ihre Bilder, ob mit Markierung oder ohne, gern auf dem Profil von jemand anderem. Im Zweifel also lieber kurz fragen, ob es auch in Ordnung ist, das Bild zu nutzen! So ist man auf der sicheren Seite.
But let's get to the manicure thing now.
You see photos of the most beautiful nails all over Instagram and they are often reposted by huge accounts to increase the attention to the artist. As long as there's credit, it's totally fine. It's more than fine, it's pretty amazing. It just makes you proud, seeing your art getting that popular.
Because really, it's called nail ART. You have an idea on your mind and instead of painting it on a piece of paper, you paint it on your nails. That's where amazing and unique creations occur.
Sometimes, when I am out of inspiration, I'm stalking my favorite IG accounts and look for their recent manicures. Not only once I recreated one of their designs, the same way or a bit different.
When I'm uploading my picture of it, I also include the original artist in the caption such as "inspired by @usernamecatkittenexample", because well, it was their idea. Not mine. And as I already said above, I don't want to claim the work of another artist as my own.
Because I know the feeling. I know the feeling of coming up with an idea, creating a unique manicure and all of the sudden seeing it on somebody else. Without any credit. Of course, it could be possible that that someone came up with the same idea. Same design, same colors, shortly after I posted mine. But let's be honest, that seems a bit weird.
It's one thing if people just copy one's manicure. But it's another thing, if they're making money out of it, if it's because they are famous YouTubers or selling that design on nail wraps or press-on nails.
And yep, that happened. Not directly to me though but to one of my friends who is also part of the community.
Let me tell you the story, because it's actually the reason for this post today.
About a year (or even more?) ago, my friend came up with a beautiful manicure I absolutely fell in love with.
I recreated it a few days later in a slightly different way and of course, mentioned in my caption that I was inspired by her to create this design.
But I wasn't the only one who liked that manicure.
Over the following weeks and months, we discovered it on many many amazing nail artist who gave credit to my friend (or me, if she didn't know her - I tagged her again in the comments then). Personally I love seeing those recreations because I feel like it's a special honor for your work if others like it that much, so they recreate it.
But almost that often, we saw the design on others who claimed it as their own idea. Maybe it was coincidence (I think not), but we even spotted a very very very similar mani on a pretty famous celebrity.
And then, my friend found out, that a company who sells press-on nails, took that exact design for one of their sets. Of course without asking. They were taking the ideas and designs of many many nail artists without any permission and the thing is, they were making money out of it. Out of someone else's idea and work. And that should be no big deal? Because it's just nails? Because it was just an image somewhere on the Internet? No, that's not funny anymore. We take it seriously.
I don't want to go much further, but My friend is on her way to handle that situation.
Jetzt aber zu dem Anlass dieses Posts.
In der Nail Art Welt gibt es so unglaublich viele talentierte Mädels (und Jungs), die sich unheimlich große Mühe machen und viel Arbeit in ihre Kunst stecken. Denn genau das ist es. Nail Art, Nagelkunst. Nur malt man eben nicht auf einer Leinwand, sondern auf den Nägeln. Dadurch ist dies aber keinesfalls weniger wert.
Wenn ich durch Instagram wandere, bin ich immer wieder erstaunt, auf was für tolle und einzigartige Ideen einige kommen.
Oft werden diese Fotos auch von sehr großen populären Accounts (natürlich mit ensprechender Markierung) geteilt, um mehr Aufmerksamkeit auf die Künstler zu lenken. Dadurch bin ich schon oft auf einige wundervolle Mädchen aufmerksam geworden.
Mir selber fehlt es dann doch manchmal an Inspiration, also scrolle ich durch meine liebsten Accounts und schaue mir ihre Designs an. Ab und an gefällt mir eins so gut, dass ich mich auch daran versuche. Poste ich aber meine Version, markiere ich natürlich die Person, von der ich die Idee hatte, unter meinem Foto. Schließlich war es ihre Idee. Nicht meine. Und auch wenn es kein Bilderklau in dem Sinne ist, so ist es doch Ideenklau und das ist, zumindest für mich, genau so unschön.
(Ein Beispiel für eine Bildunterschrift wäre hier: "Zu dem Design hat mich die liebe @nagelkatzebeispielname inspiriert!". Oder so ähnlich.)
Leider weiß ich nämlich, wie das ist, seine Idee auf den Nägeln von jemand anders zu sehen.
Es kann natürlich auch immer Zufall sein. Zufällig das gleiche Design, zufällig die gleichen Farben, zufällig kurz nachdem ich meinen Look geteilt habe. Aber seien wir ehrlich, so wirklich glaube ich an solche Zufälle nicht.
Es ist natürlich ärgerlich, wenn einem eine Idee einfach geklaut wird. Wenn es aber dabei bleibt, gut, dann ärgert man sich kurz, aber den Tag lässt man sich von sowas auch nicht vermiesen.
Anders aber ist es, wenn diejenige Ideenklauende Person Profit daraus schlägt.
Hier möchte ich kurz die Geschichte einer Freundin von mir erzählen, denn sie war letztendlich ausschlaggebend für den heutigen Post.

Also.
Vor etwas über einem Jahr zauberte meine Freundin, die auch Teil der Nail Art Community auf Instagram ist, ein wunderschönes Design auf ihre Nägel. Ich war total hin und weg (wie üblich) und pinselte es in etwas abgewandelter Form auch auf meine Nägel. Natürlich markierte ich sie unter dem Bild, denn, wie gesagt, es war ihre Idee. Ihre Kunst. Ihre Arbeit.
In den folgenden Wochen und Monaten sahen wir dieses Design auf den Nägeln vieler Mädchen.
Viele von ihnen markierten meine Freundin oder mich (falls sie sie nicht kannten, ich erwähnte sie dann aber doch noch einmal in den Kommentaren) und es war wirklich toll zu sehen, was für Wellen dieses Design schlug und wie viele Mädchen sich mit uns darin verliebt hatten.
Leider gab es auch immer wieder einige, die nicht kenntlich machten, die Idee von jemand anderem zu haben.
Gut, man muss auch sagen, dass die Fotos nun schon weit über Instagram hinaus gingen - so waren sie auch auf Google, We Heart It und Pinterest zu finden. Aber fängt da das Problem nicht bereits an?
Es zog solche Kreise, dass wir es sogar auf den Nägeln einer nicht unbekannten Promidame entdeckten. Ja, auch das kann Zufall sein. Aber bei so einzigartigen Designs, wie diesem, wird man doch leicht skeptisch.
Dem ganzen wurde jedoch die Krone aufgesetzt, als vor einigen Wochen die ganze Nail Art Community mal wieder in heller Aufruhr war. Das kommt zwar immer mal wieder vor, aber diesmal war tatsächlich etwas im Argen.
Eine Firma, die Nägelsets zum aufkleben herstellte und verkaufte, nutze die Designs von verschiedenen bekannten und unbekannten Instagram Nail Artists. Und zwar wirklich in einem Ausmaß, dass es mich wundert, dass sie dachten, damit durchzukommen. Die Muster waren teilweise so einzigartig (und dadurch in der Nagelwelt natürlich bekannt!), dass man sie gleich dem entsprechenden Artist zuordnen konnte.
Auch meine Freundin fand ihr Design hier wieder. Exakt das gleiche Muster, die gleiche Farbauswahl.
Nun ist es, wie gesagt, eine Sache, eine Idee zu klauen. Aber wenn derjenige sie zu Geld macht, da hört der Spaß auf.
Meine Freundin hat sich diesbezüglich Hilfe geholt, das möchte sie nicht auf sich sitzen lassen. Ich habe auch andere der betroffenen Nägelmädchen kontaktiert, es wurde in jedem Fall etwas unternommen. Ich darf leider nicht mehr verraten, nur so viel: Manchmal hilft es, die Krallen auszufahren.
So giving credit is important, always remember that. Nobody walks into the Louvre, copies the Mona Lisa and tries to sell it with their own name on it, right? So why should we?
Also denkt bitte immer dran, Urheberrechte sind ernst zu nehmen.
Ich meine, es dackelt ja auch niemand in den Louvre, malt die Mona Lisa ab und vermarktet sie dann als sein eigenes Werk, oder? Wieso sollten wir das dann tun?
